Colby has litigated patents involving a broad array of technologies including firewalls and unified threat management, 802.x standards and other wireless componentry, firearms, global positioning systems, web conferencing, streaming media, electro-static discharge tools, RFID, and wind turbines. In addition to his patent litigation practice, Colby has an extensive copyright, trademark, and unfair competition practice. Colby has represented a variety of clients with respect to claims of copyright infringement including matters involving copyright misuse and DMCA safe harbors. Colby has both prosecuted and defended cases in venues across the country involving the Lanham Act, including claims of trademark infringement under Section 1114, false designation of origin and misleading description under Section 1125, as well as unfair competition and false advertising likelihood of confusion.
