What's New

We've updated these Terms to:

  • Clarify Review Ownership: The original author of each review keeps ownership of their words, while Experience.com, the professional, and/or the business, each receive broad rights to use the review for marketing, analytics, and display.
  • Explain Cookies and Identification Pixels: When you click "Allow," Experience.com may collect limited visitor data and share it only with the specific professional and/or their company whose page or pages you visited.
  • Describe Subscription Renewals: Individual professional subscriptions renew automatically after the first year, converting to monthly billing to avoid unexpected annual charges.
  • Align Governing Law: Disputes are now resolved under Delaware law, while all consumer protections (DMCA, COPPA, California notices) remain in place.

1. Introduction and Acceptance

These Terms govern your access to and use of:

  • Our websites, including https://www.experience.com
  • Any related online services, pages, or features we operate (collectively, the Platform)

"Experience.com," "we," "our," and "us" mean BuyersRoad, Inc. d/b/a Experience.com.

By accessing or using our Search Tools and/or the Platform, you:

  • Agree to these Terms
  • Agree to our Privacy Notice and other linked policies
  • Confirm you have authority to agree on behalf of yourself or your organization

We may send important notices by email or posting them on the Platform. Electronic communications satisfy any legal requirement that they be in writing.

When you use Experience.com, you agree to these rules and to receive information electronically.

2. Account Types, Roles and Eligibility

Experience.com serves:

1. Visitors & Reviewers

Individuals who browse the platform, view profiles or business pages, or submit reviews.

2. Businesses & Professional Accounts

Includes:

  • Professional-led accounts (e.g., realtors, loan officers, attorneys) who claim and manage their personal profiles.
  • Business-led accounts (e.g., restaurants, boutiques, dispensaries, fitness studios) that promote a location, brand, or service, even if no individual professional represents the business.

These users manage their own presence on the platform and may subscribe to paid plans.

3. Enterprise Subscribers

Organizations with multiple users, locations, or teams operating under an Enterprise Subscription Agreement or MSA.

You must be 18 or older to use the Platform. We do not knowingly collect information from children under 13; contact support@experience.com if you believe we have.

Plain meaning:

Experience.com is for adults using it professionally or as consumers, not for anyone under the age of 18.

3. Using Experience.com

3.1 General Use

You may use the Platform only for its intended purposes and under lawful conditions. We may suspend or restrict access for misuse or security reasons.

3.2 Prohibited Activities

You may not:

  • Break laws or violate rights
  • Access unauthorized areas or data
  • Scrape, crawl, or overload systems
  • Introduce malware or spam
  • Impersonate others or mislead users
  • Post illegal, harassing, or offensive content
  • Use the Platform to build or train a competing product

3.3 Third-Party Content and Links

Third-party websites, content, or tools may appear on the Platform. We don't control or endorse them; their terms apply to you.

3.4 Geographic Use

Our headquarters is in California, USA. If you use the Platform outside the U.S., you are responsible for complying with local laws.

4. Reviews, Other Content and Feedback

4.1 Reviews and Ownership

The author owns their original review content.

4.2 Licenses for Reviews

By submitting a review, the author grants:

Experience.com -- a perpetual, worldwide, royalty-free, transferable, sublicensable license to use, store, publish, and display the review in any medium for lawful purposes.

The professional, business, or organization associated with the page you reviewed -- a similar license to use, publish, and display the review for marketing, promotion, or customer engagement, provided they do not materially misrepresent your words.

Reviews may be used without notice or compensation.

4.3 Other User Content

If you upload profile info, logos, images, or documents, you grant Experience.com a worldwide, royalty-free license to use and display that content to operate and promote the Platform.

4.4 Feedback

Suggestions or ideas sent to us may be used freely without compensation.

4.5 Public Nature and Moderation

User content may be public and cannot always be removed. We may edit or delete content that violates these Terms or law.

Author's own what they write, but they let us and the professional use it broadly.

5. Data Collection, Cookies & Visitor Identification

5.1 Cookies and Pixels

All Experience.com pages use cookies and pixels for core functions, analytics, and marketing. They collect technical information like browser type, IP address, and usage patterns.

5.2 Identification Pixels on Professional Pages

When you visit a professional's page and click Allow, we may collect and share with that professional limited data (name, email, demographics, address, social links, title, and visit details). You may withdraw consent any time via the cookie banner. The specific fields collected and retention limits are described in our Privacy Notice. We retain identification-pixel data for up to 24 months from your last visit or until you withdraw consent, as described in the Privacy Notice.

5.3 Scope and Control

Identification data is shared only with the professional and their company. We may use aggregated data for analytics.

Plain meaning:

Standard analytics run on all pages; identification pixels run only when you click Allow.

6. Individual Professional Subscriptions

6.1 Plans and Payments

Professionals may choose monthly or annual plans (the annual includes a discount).

6.2 Automatic Renewal and Monthly Conversion

All non-enterprise subscriptions (including individual professional and business accounts) renew automatically for an additional 12-month term unless canceled in advance. To prevent unexpected lump-sum charges, renewal terms are billed monthly at the then-current monthly rate; however, each renewal is a binding 12-month commitment. Monthly billing changes the payment schedule only and does not convert the plan to a month-to-month subscription unless we expressly state otherwise in writing.

6.3 Cancellation

Cancel through Billing & Upgrades to stop renewal; access continues through the current term. Refunds only where required by law.

Annual plans renew and then switch to monthly billing to avoid surprise charges.

7. Enterprise Subscribers

Enterprise customers operate under a separate agreement (MSA or Enterprise Subscription Agreement). If conflicts arise, the enterprise agreement controls.

Plain meaning:

Your MSA overrides these Terms if they conflict.

8. Intellectual Property and Copyright

8.1 Platform IP

Experience.com owns the Platform, software, design, and trademarks. You may not copy or reverse engineer them without permission.

8.2 Data and Metadata

Experience.com owns aggregated and anonymized data and improvements created through the Platform.

8.3 Copyright Complaints (DMCA)

9. Disclaimers and Liability

Experience.com is provided "as is." We make no warranties and are not liable for indirect or consequential damages. You agree to indemnify us for claims arising from your use or content.

Use at your own risk; we limit our liability to the extent allowed by law.

10. Governing Law and Arbitration

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms will be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA). The arbitration will take place in Contra Costa County, California, before a single arbitrator under the AAA Commercial Arbitration Rules. No class actions, class arbitrations, or jury trials are permitted.

11. Updates and Contact

We may update these Terms without notice. Continued use means acceptance.
